The Decree stipulates fine amounts for regulation violations in fields such as State- funded investment; domestic investment, foreign investment, Vietnamese investment in abroad; bidding; and business registration. Accordingly, fine levels are increased, particularly in fields of investment and business registration.
Violations of administration regulations in ODA funding projects and programs such as failing to monitor and to supervise programs or projects implementation or delay in comparison with schedule without any objective factors or force majeure event will be fined up to VND 10 million
A fine from VND 20 million to VND 30 million shall be imposed for contraventions with the contents stated in the investment decision.
A fine of between VND 5 million and VND 10 million shall be imposed to companies providing false information, documents to parties in the contract, engineering and performance consultants of ODA program and projects.
Failures to comply with regulation in concern of ODA program, projects implementation reports to competent agencies as stipulated will be fined between VND 1 million and VND 2 million
Failure to make report or untruthful reports about investment activities will be sanctioned from VND 5 million to VND 10 million and from VND 10 million to VND 15 million. In the previous decree, these fines were from VND 100,000 to VND 200,000.
Investment delay than the schedule will have the fine level from VND 15 million to VND 20 million, instead of VND 1 million to VND 3 million as before
Untruthful declaration of business registration record, a paid in capital less than registered fund are fined respectively from VND 10 million to VND 15 million and from VND 10 million to VND 20 million, while the previous levels were from VND 3 million to VND 5 million and from VND 7 million to 10 million.
This Decree takes effect from January 1, 2014./.
